Copyright Infringment!

Holy crap! I cannot believe this. I've been kind of in pain today because of the arm. But I wanted to check my email and make sure there was nothing pressing that my vicodine drowsy mind had to deal with...and I find out someone is nicking my website!

For those of you who don't know, my company website is at www.comstar-media.com. We're a small publisher and we've just started to get some product info up. Well, our webmaster/disigner contacted us today and let us know that some idiot has put our site up on her server and is claiming it as her own!

First let me submit exhibit A: http://julies.net/comstar/index1.php. As you can see, our logo, our index header, my company email addy, and the company name is all over this. Plus, it says that it's copyrighted to us at the bottom of the page. The things changed include Liz's name as the author of In Shadowside, the header graphic that says King Solomon Books instead of ComStar Media. In the menu you can see where she started to change all occurances of ComStar Media to King Solomon Books, but didn't finish. None of the links work, so don't even try.

Exhibit B: http://julies.net/comstar/index.php. This is where it really gets bad. You can see how she's kept the same basic design of our site (right down to the way our links are underlined in dashes rather than straight lins) and started changing the text. This one claims that she's the copyright owner and that it's her design! The menu system is taken out of this one and very few links work. The only link that does work that I found is the one that leads to her email address of julie@julies.net.

So I wrote to her to tell her that we're going to take action and our webmaster is in communication with the server to get it torn down. But I am P-I-S-S-E-D! Grr!

I think I'm more made that someone took the time to put Ashley Leon in place of Elizabeth Ashe for the writer of In Shadowside than anything else. This looks soooo bad. I am so going to crusify this person!

Did you know that even if you make no money whatsoever from a copyright infringment that you can be forced to pay a fine of $25,000? That's if you've made absolutly no money at all. If you've made money than your entire profit can be forfeit and if you've made over $1,000 profit it's criminal rather than civil and you can be forced to pay 3x the amount you made. Now, I'm no lawyer, but this is what I've been told from research. $25,000 is a lot of money, especially if you're making diddly on your theft. I have no idea why someone would do that.

Now, if she takes it off her server and doesn't do it again, fine. We'll leave it alone. But if I get one nasty letter from her, I'm so taking it to our lawyer. As it is I'm going to contact the lawyer to let her know what's going on.

I've been telling lots of people about this. Pisses me off that this is Christian company is being linked to some very un-Christian actions. That's like the icing on the cake. I hope she gets inundated with emails about what a dirty thief she is. *fumes*

I'll get this taken care of Liz. I think it's only been up for a few days, but we'll make sure to get it taken down. I feel like this effects you more than the other customers because your name was the one changed. :(

Ok...I'm off to be pissed off by myself.

Did you take screencaps of the pages? I would do that if I were you, in case you need them as evidence later.

You have a way to contact her? Because I was looking and couldn't find it. Because I have a few things to say about this. I mean, if people thought I got upset about claiming my fics as their own, that's NOTHING compared to what I'd do about people claiming my WORK as their own.

Please keep me updated, and please go after her with everything.

Her email address seems to be julie@julies.net, but I dunno. I have written and our webmaster has written. We haven't gotten a response yet.

As a web designer and programmer I can kinda see someone wanting to figure out how the layout/menu code was done (the menu code in particular - its very cool). However, there are certain rules you have to follow when "borrowing" someone else's site/page like that. First being you DON'T POST THE COPY YOU'RE WORKING ON ONLINE!!! And if for some truly bizarre reason the *only* way you can get it to work IS for it to be online: you put it in a remote directory, that has a nice (and preferably password protected) index page stating VERY clearly that the following work IS NOT yours and you're only playing for a bit, you then make DAMN sure you've got that same little disclaimer repeated many many many times in the text that you're tweaking. And above all: you do NOT give anyone the link to that online test page and you DO make sure it's not searchable by any robots! ::headdesk::

And if this moronic twerp *is* trying to steal your site or take credit for Liz's work? Please, please, please throw everything possible at her. She's totally got it coming.

I was appalled at the ComStar list notice about this, but a part of me really didn't want to believe that anybody would be so... I guess stupid is the word that comes to mind. Let's just steal outright the entirity of a site-layout, complete with the site-only data and commentary, the partial weekly site update, and... Never mind that it says on the Comstar site that 'all content belongs to ComStar Media', never mind that it says that it's copyrighted and that you shouldn't take it, never mind that common sense alone says it's a bad idea... Someone decided to just lift the whole page, and start making a few tiny, even-less-legal changes like a different company at the top and nowhere else, and oh, let's try to give credit for Echo's hard work to someone else...

It's horrible, and I feel a distinct lack of suitable words to express my dismay.

Just when you think you've seen the lowest that people will go, someone starts digging.

Ok so apparently she's been doing this for a bit now. This julie that we're all bitching about (http://.julies.net) apparently pissed off another julie (http://www.juliesjournal.com)

I looked around and found julie at julieslournal.com posting about how a certain christian julie stole her shit. Here's the cool julie bitching about the bitch ass julie.

I read through her 100 things post....and I just don't know.

I kind of started to feel sorry for her in a way. But then I remembered she was stealing my business page and got over it.

The thing that really confuses me is how she claims to have built pages for other companies and how she's a programmer but then in the same "breath" (if you will) she says that she likes to take other people's designs and make them her own.

When I did webpage design, I did look at other websites for my starting inspiration. I saved them in my favorites and looked at their code (which used to be easier before people put most of their info into Cascading Style Sheets) and I would learn how they did something. Then...I did a real novel thing. I did it myself. I didn't copy and paste, but I did it myself. Usually I would end up changing things to make it my own and the site would end up different enough that no one could say I copied it--but they might be able to see my inspirations. But then again, I'm not trying to hide my inspirations.

I guess my point is, that if she was really a programmer, wouldn't she be able to come up with pages on her own, without stealing? I would think so. And while our webmaster is brilliant (particularly because he's self-taught), he has worked very hard to learn all the techniques that he uses on the site and doesn't deserve to have his ideas stolen. Neither does our authors deserve to have their names replaced.
